
If your spouse, parent or child or brother or sister has been killed in an accident, or as a result of a disease, you can claim compensation. Instead of an award of solatium, you can recover an award for ’loss of society’. In addition, you can recover compensation for the loss of support which you no longer receive as a result of the death. Again, there is a time limit on these cases of three years from the date of death.
Under a recent change in the law, a person who dies having a right to claim compensation prior to his death will transmit that claim for compensation to his legal estate, and his next of kin can continue with the claim.
